Terms & Condititions

IMPORTANT OPERATIONAL POINTS:

• A tour would operate on a minimum operational strength of 4 full paying persons. Incase minimum operational strength is not met or minimum 4 full paying persons are not booked on a group departure, the tour departure would be cancelled and persons booked would be intimated 30 days prior to departure date. Any deposits made by person booked towards tour cost/ booking would be refunded 100% and full refund is entitled only when the company cancels the tour on its own decision. Incase booked person would still like to travel, arrangements for same can be made and any extra costs/ supplements applicable would have to be paid directly over the group tour cost already paid. Also a person booked would be provided with an opportunity or date to join other group departure date and incase he/ she is willing or interested to join another group of same tour programme on a different date, he/ she would be accommodated
• We “Himalayan Saga” reserve the right to cancel or change the date of group departure within 30 days of an advertised date of departure.
• It is in the nature of a holiday of this kind (Adventure Tour) to be flexible. The day to day agenda and ultimate goal of the tour is taken as an aim and not as a contractual obligation. We shall not be responsible for the delays or alterations in the program or expenses incurred due to rain, landslides, flood, conflict, internal flight delay or cancellations, strikes, sickness, weather, war, vehicle problems, political closures and disputes. Any alterations in programmes and any extra expenses thus incurred due to any reason beyond our control has to be settled directly if such charges come up to make necessary amendments and arrangements for a safe passage. Failing direct settlement of expenses, the company in operation would have to furnish us a guarantee of payment in writing and make payments before the tour services terminates.
• Motor Biking is an adventure activity and the rates donot cover any insurance, risk cover, damages, claims etc. A person coming on adventure tour has to be covered for adventure travel & activities apart from normal travel insurance. Himalayan Saga or any of its service providers would not be liable in any case for any mishap/ loss etc.
• A person should be covered under travel insurance and the insurance should also include adventure travel indicating riding a motorbike in India. Our tour costs donot include any travel insurance/ repatriation charges/ damages/ claims etc incase of any eventuality
• Your participation in a trip is entirely at your own risk. We are NOT responsible or liable for any injuries you may suffer, fatal or otherwise. Also, we are NOT responsible for any loss or damage to your property, including your motorcycle, irrespective of how any damage may have been caused.
• We will provide 500 cc Enfield as per itinerary (without Fuel) and would be paid directly by the rider. We would give you bike with full fuel tank on returnable basis and any fuel consumed would be paid directly
• This tour has to be confirmed at least 60 days before arrival date and a minimum 25% non refundable deposit would be required
• We will provide 01 support vehicle (utility jeep or mini truck) which would carry mechanic/ spares/ client baggage only
• Mechanic would carry basic spares for the bikes. Any wear & tear or damage to bike or maintenance spares required have to be paid in actual (extra) to the mechanic by group members
• At the start of the tour, a refundable security/ damage deposit of Rs 20000/- per rider would have to be made to Himalayan Saga
• Damage of the bikes of any kind due to any accident/ fall or any other reason etc during the tour would have to be paid by the guest as per actual cost occurred for the damage.
• Incase of any eventuality of any kind, bike damages have to be paid. Also guest has to have his own insurance from country of origin which covers such a tour
• Bike rider need to have a valid International (for foreigners)/ National (for Indians) Driving License which should cover driving a Two Wheeler
• The accompanying guide (coordinator) would not ride the bike but would follow the group in the support vehicle only
• Group members would have to get own helmets/ knee guard/ elbow guards/ shoes/ biking trousers & jackets. Wearing a helmet is mandatory
• For Foreign tourist travel from Spiti to Kinnaur, inner line permit is required. The permit would be processed by us on behalf of traveler in Kaza or Shimla for which a copy of passport/ Visa/ 4 passport size photographs are required

IMPORTANT NOTE:

• Services subject to full advance payments only
• Cost incidental to any change in the itinerary/ stay on account of flight cancellation due to bad weather, ill health, roadblocks and/or any factors beyond control.
• For any adventure tour a person should be covered under travel insurance. All our rates donot include any travel insurance/ repatriation charges/ damages/ claims etc incase of any eventuality. Insurance cover has to be from the guests country of origin only and cannot be done here in India on arrival
• Please note, the names of hotels mentioned above only indicate that our rates have been based on usage of these hotels. It is not to be construed that accommodation is confirmed at these hotels until and unless we convey the confirmations to you on receipt of your acceptance. However in the event of any of the above mentioned hotels not becoming available at the time of initiating the reservations, we shall book alternate accommodation at a similar or next best available hotel and shall pass on the difference of rates (supplement/reduction whatever applicable) to you.

Company Liability:

• A person booking any of group departure or tour of Himalayan Saga would have to give an undertaking stating that he/ she has been communicated very clearly all the Terms & Conditions of the tour and he/ she understand fully the risks involved in a holiday of this kind and incase of any death, accident, mishap that may occur during the course of tour would be his/ her sole responsibility and the company or any of its associates/ team members would not be responsible or liable in any case.

• The booking is accepted on the understanding that you realize the potential risks and hazards that can be involved in holidays of this kind. Himalayan Saga, along with our leaders/guides and any one else working in association with us can not be held responsible for any death, accident or mishap that may occur in connection with any part of, or services connected with the holiday.
• The cost is for the entire package and there would be no refunds in case any part of the package is not availed.
• A person should be covered under travel insurance and the insurance should also include adventure travel indicating riding a motorbike in India. Our tour costs donot include any travel insurance/ repatriation charges/ damages/ claims etc incase of any eventuality

• The Company would not be liable to pay any kind of compensation arising because of any mishap, sickness, accident etc.

Payment & Reservation Terms:

You can make reservations with us by advising us your acceptance of the tour and travel dates along with 25% of total tour amount as booking amount. Incase travel dates lie within two weeks of period we would require full payments in advance to initiate reservations. We would immediately proceed to make tentative bookings. All services would be kept on confirmed basis on receipt of full advance payments only. You can make payments by depositing cash/ cheque in our ICICI account (Account Name: Himalayan Saga, No: 635305000205, The Mall, Shimla HP). Once the bank intimates us about money being credited into our account we would immediately confirm all you travel arrangements and forward you travel documents/ service vouchers against which you would be provided rooms at hotel.

Cancellation & Operational Policy:

25% of total tour cost charged as cancellation charges for booking once made. 50% charges apply between 30 days & 15 days and no refunds there after. If any part of package is not availed, refunds cannot be claimed for and neither is any part of package exchangeable with some other services. Incase extension of a tour is required, supplement as applicable would be paid directly to us by the clients
